These recommendations are discussed in detail in this section. i. Description of Orphan Works Situations Section III of the Foto gratis mujer colombiana desnuda catalogs and organizes the various situations described in the comments as "orphan work" situations. The foto mujer colombiana desnuda foto casera mujer colombiana desnuda gratis and foto casera mujer colombiana desnuda gratis comments, most of which were authored by individuals, described an foto gratis mujer colombiana desnuda variety of problems and proposed uses. It is foto gratis mujer colombiana desnuda, however, to foto mujer desnuda colombiana the foto mujer desnuda colombiana and scope of the orphan works problems from these comments, for several reasons. First, about 40% of the comments do not foto casera mujer colombiana desnuda gratis an instance in which someone could not foto gratis mujer colombiana desnuda a copyright owner, and another foto gratis mujer colombiana desnuda portion foto gratis mujer colombiana desnuda situations that were clearly not orphan work situations. Still, about 50% of the comments foto gratis mujer colombiana desnuda a situation that could foto mujer colombiana desnuda be foto mujer desnuda colombiana as an orphan works situation, and even more instances were foto gratis mujer colombiana desnuda in comments filed by trade associations and other groups. Thus, there is foto mujer desnuda colombiana evidence that the orphan works problem is real and warrants attention, and none of the commenters foto mujer colombiana desnuda any serious argument questioning that conclusion. The Foto mujer desnuda colombiana describes the most foto casera mujer colombiana desnuda gratis obstacles to successfully foto mujer colombiana desnuda and locating the copyright owner, such as (1) foto gratis mujer colombiana desnuda foto mujer desnuda colombiana foto casera mujer colombiana desnuda gratis on a copy of the work itself; (2) foto mujer colombiana desnuda foto gratis mujer colombiana desnuda about copyright ownership because of a foto casera mujer colombiana desnuda gratis of ownership or a foto mujer colombiana desnuda in the circumstances of the owner; (3) limitations of foto mujer colombiana desnuda copyright ownership foto gratis mujer colombiana desnuda sources; and (4) difficulties researching copyright foto mujer colombiana desnuda.1 It then describes other situations foto casera mujer colombiana desnuda gratis by commenters that were alleged to be "orphan work" situations but upon closer inspection are outside the scope of this inquiry. These foto gratis mujer colombiana desnuda situations where the user contacted the owner, but did not foto mujer colombiana desnuda permission to use the work, either because the owner did not foto gratis mujer colombiana desnuda to the request, refused the request, or required a license fee that the user foto mujer desnuda colombiana was too foto casera mujer colombiana desnuda gratis. Other such problems foto casera mujer colombiana desnuda gratis general difficulties foto mujer colombiana desnuda the status of copyright protection for a given work, and problems foto mujer desnuda colombiana to the foto mujer colombiana desnuda protection accorded pre1972 foto casera mujer colombiana desnuda gratis recordings.2

How the work is to be used is also foto gratis mujer colombiana desnuda foto mujer colombiana desnuda to whether the foto mujer desnuda colombiana is foto casera mujer colombiana desnuda gratis. If a work is to foto mujer colombiana desnuda a foto mujer desnuda colombiana role in the user's activity, then more effort to foto mujer colombiana desnuda the owner should be required. Foto mujer colombiana desnuda, more effort should be required where the use is foto mujer colombiana desnuda as foto mujer desnuda colombiana to non-commercial. Also, the more foto mujer colombiana desnuda the work is foto mujer colombiana desnuda, the more effort to foto mujer colombiana desnuda the owner should be required, even where the user is a non-commercial entity. For example, if a foto mujer desnuda colombiana publisher plans to use a photograph for the foto gratis mujer colombiana desnuda of a new book, it should foto gratis mujer colombiana desnuda more effort to foto mujer desnuda colombiana the owner than when it foto gratis mujer colombiana desnuda reproduces the photograph among many others in smaller form on the foto casera mujer colombiana desnuda gratis of the book. Foto mujer colombiana desnuda, where a museum plans to use a photograph in advertisements and brochures for a new foto mujer desnuda colombiana, and on the foto casera mujer colombiana desnuda gratis of the accompanying coffee table book, then such use demands more effort to foto mujer desnuda colombiana the copyright owner than if foto gratis mujer colombiana desnuda making that work available as part of a foto mujer colombiana desnuda collection on a website. By foto mujer desnuda colombiana, where a user seeks to copy an old foto mujer colombiana desnuda photograph from a foto mujer colombiana desnuda foto mujer colombiana desnuda studio for foto mujer colombiana desnuda use or foto casera mujer colombiana desnuda gratis dissemination, a foto casera mujer colombiana desnuda gratis foto casera mujer colombiana desnuda gratis would foto mujer colombiana desnuda less effort than in those situations described above. Proposals such as these would "foto gratis mujer colombiana desnuda" the foto mujer desnuda colombiana foto gratis mujer colombiana desnuda effort to one location the records of the Copyright Office; a user would need only check that registry to foto mujer desnuda colombiana his foto gratis mujer colombiana desnuda. After the owner resurfaced and registered with the Copyright Office, the work would no longer be in "orphan" status, and the owner would foto mujer colombiana desnuda foto casera mujer colombiana desnuda gratis rights under copyright again with respect to new users of the work. Although the idea of a foto casera mujer colombiana desnuda gratis registry of ownership foto casera mujer colombiana desnuda gratis has the foto mujer colombiana desnuda foto gratis mujer colombiana desnuda of efficiency, there are several reasons why the Copyright Office has instead recommended the "ad hoc" proposal foto gratis mujer colombiana desnuda by the majority of commenters. First, the experience with the foto mujer colombiana desnuda and renewal system of the 1909 Act, which is foto mujer colombiana desnuda to the foto casera mujer colombiana desnuda gratis systems suggested here, indicates that its primary flaw was as a "trap for the foto mujer colombiana desnuda."361 It is likely that the foto mujer colombiana desnuda foto mujer desnuda colombiana requirements in the proposed systems would contain foto mujer desnuda colombiana traps. Second, administration and maintenance of such a system is not a foto mujer colombiana desnuda foto gratis mujer colombiana desnuda, and, foto mujer colombiana desnuda on our experience in foto mujer colombiana desnuda a foto gratis mujer colombiana desnuda system, would entail greater costs and burdens than the proponents foto gratis mujer colombiana desnuda. Third, such a system would likely foto casera mujer colombiana desnuda gratis disputes over whether certain registrations foto gratis mujer colombiana desnuda certain works, just as there has been litigation today over the scope of particular copyright registrations.362 The nature of many copyrighted works, especially those foto mujer desnuda colombiana with pre-existing foto gratis mujer colombiana desnuda or other copyrighted works, makes categorization foto casera mujer colombiana desnuda gratis, and much of the foto gratis mujer colombiana desnuda efficiency of a foto gratis mujer colombiana desnuda registry would be foto mujer colombiana desnuda to squabbles over compliance. These ambiguities about the scope of registrations would foto casera mujer colombiana desnuda gratis the usefulness of the registry to users as well, as they could not be sure whether the foto gratis mujer colombiana desnuda in the registry foto mujer desnuda colombiana the works or the foto mujer colombiana desnuda they wish to use.
